6-3-9: CITATIONS:
   A.   Parking Citation: A parking citation shall be issued to the owner or operator of any vehicle in violation of any of the provisions of this chapter. The citation shall indicate the nature of the violation, the amount of the fine, the method by which the fine shall be paid, and the procedure by which the person receiving the citation may obtain a hearing to contest the issuance of the citation. (1982 Code § 5.291)
   B.   Administration: The city clerk, or a designated agent of the city clerk, shall receive, process and make records of all parking citations issued and fines paid. The city clerk shall submit summarized monthly reports to the city council of all fines collected and the nature of the violations. All monies obtained from the fines shall be deposited with the city treasurer and shall be a part of the general fund. (1982 Code § 5.292)
   C.   Hearing:
      1.   Request For Hearing: Any person who desires to contest a parking citation shall, within seven (7) days of its issuance, submit to the city clerk a written request for a formal hearing.
      2.   Schedule Of Hearing; Notice: The request shall be forwarded to the proper court, at which time a court hearing shall be scheduled and notification of it sent to the alleged violator.
      3.   Court Costs: If the court determines that the alleged violator was in violation of a provision of this chapter, the court may assess the violator reasonable court costs in addition to any penalty imposed. (1982 Code § 5.293)
   D.   Nonpayment Of Fine: Any violator who fails to pay the fine indicated or submit a written request for hearing within seven (7) days from the date of issuance of the citation shall be guilty of a petty misdemeanor, except that when preceded by two (2) or more violations within the preceding twelve (12) months, a violation shall constitute a misdemeanor.
