4-7-1: DEFINITIONS:
As used in this chapter, the following terms shall have the meaning given to them:
COMMERCIAL HANDBILL: Any handbill which:
   A.   Advertises for sale any merchandise, produce, commodity or thing;
   B.   Directs attention to any business, mercantile or commercial establishment, or to any other activity, for the purpose of directly or indirectly promoting the interest of the establishment or activity by increasing its sales;
   C.   Directs attention to or advertises any meeting, performance, exhibition or other event for which an admission fee will be charged or collection taken up for private gain or profit, but not for which the admission fee will be charged or collection will be taken up for the purpose of defraying the expenses incident to the event; or
   D.   While containing reading matter other than advertising, is predominately and essentially an advertisement and is distributed for advertising purposes or for the gain of any person engaged in advertising in or distributing it.
HANDBILL: Any printed, written or reproduced bill, announcement, notice, circular, dodger, leaflet, pamphlet, booklet or similar matter designed or actually used for distribution to others of the information contained in or on it by handing it to others, by posting it, or by leaving it upon or at any property to be seen or picked up and examined, but it does not include any such item distributed by mail or any newspaper.
NEWSPAPER: Any newspaper of general circulation as defined by law, any newspaper duly entered with the United States postal service, any newspaper filed and recorded with any officer as provided by law, and any periodical or magazine regularly published with not less than four (4) issues per year and sold to the public.
NONCOMMERCIAL HANDBILL: Any handbill not included in the definition of a commercial handbill.
PRIVATE PREMISES: Any dwelling, building or other structure designed or used wholly or in part for private residential purposes, whether inhabited or temporarily or continuously uninhabited or vacant, and includes any driveway, porch, steps, vestibule or mailbox belonging or appurtenant to the structure.
PUBLIC PARK: Any park, reservation, playground, beach, recreation center or any other public area owned or used by the city and devoted to active or passive recreation.
PUBLIC PLACE: Any street, sidewalk, boulevard, alley, public way, or any public park, square, spaces, grounds, or buildings. (1982 Code § 7.341)
