(a) No person shall operate a snowmobile or all-terrain vehicle (ATV) in the City on any street or highway or upon any sidewalk, parkway or island situated within any divided or other roadway unless a state of snow emergency, as defined in Section 400.05, has been declared by the City Manager or the Chief of Police.
(b) No person shall operate a snowmobile or all-terrain vehicle (ATV) in the City in any public park or on any public grounds unless the surface of the soil is firmly frozen, and then only on designated snowmobile trails or in designated snowmobile areas within such park or grounds. The City Manager shall have the authority to authorize exceptions to this division by posting signs indicating such exceptions when, in his or her opinion, no damage to City property will result.
(c) No person shall operate a snowmobile or all-terrain vehicle (ATV) within the City upon or across any private property without the written permission of the owner or his or her agent in advance of such operation.
(d) No person shall operate a snowmobile or all-terrain vehicle (ATV) within the City between the hours of 11:00 p.m. and 8:00 a.m. except during a snow emergency.
(e) No person shall operate a snowmobile or all-terrain vehicle (ATV) within the City, except on private property with permission as provided for herein, while towing any sled, toboggan, skier, or any other snow vehicle or other conveyance or device, unless such towed vehicle is designated for such use and is attached to the snowmobile or all-terrain vehicle (ATV) by means of a hitch mechanism designed and manufactured for such purpose.
(f) No person shall operate a snowmobile or all-terrain vehicle (ATV) within the City in such a manner as to endanger the life or property of another, in such a manner as to emit radio frequency electromagnetic radiation such as to cause radio frequency interference to normal radio or television, or in such a manner as to constitute a nuisance by reason of excessive noise or otherwise.
