246.07 REQUESTS FOR PROPOSALS; FORMAL CONTRACTS; BIDDING AND REQUEST PROCEDURES.
   (a)   Except as otherwise provided in this chapter, competitive bidding or requests for proposals are required for all supplies and contractual services when the estimated cost thereof exceeds the amount specified in Section 246.06 (a)(2) and (b).
   (b)   Council shall authorize the purchasing agent to solicit sealed bids and requests for proposals from all responsible prospective suppliers. If MI Deal or another similar State program is part of the bidding process, this fact shall be disclosed at the time of the solicitation of bids and requests for proposals.
   (c)   Whenever possible, purchases shall be made from local vendors. For purposes of this chapter, "local vendors" are vendors with a business location in the 48423 zip code area. This will be accomplished by ensuring that local vendors who have goods or services of which the City is in need are included in the competitive process that will precede most purchases and have preference in the event of a tie bid or proposal as set forth in this chapter.
   (d)   Notice Inviting Bids and Requests for Proposals.
      (1)   A notice inviting bids and requests for proposals shall be posted on the website for the City of Davison at least five days preceding the last day or deadline for submission of bids or proposals. The purchasing agent shall also advertise all pending purchases or sales by a notice posted on the public bulletin board at City Hall. Alternative methods of inviting bids and requests are also acceptable and these include, but are not limited to, the State bidding process, telephone, fax, email, and newspapers. The methods used of inviting bids should be those calculated to reach the widest possible number of responsible bidders taking cost into consideration.
      (2)   The notice required shall include a general description of the goods or services to be purchased or sold, deadline for submission of bids or proposals, and the time and place for bid and proposal openings. If there are additional specifications not contained in the notice, the notice shall state where these specifications may be secured.
   (e)   Bid Deposits. When deemed necessary by the purchasing agent, bid deposits shall be prescribed in the public notices inviting bids. Unsuccessful bidders shall be entitled to the return of such bid deposits where the purchasing agent has required such bid deposits. A successful bidder shall forfeit any bid deposit required by the purchasing agent upon failure of the bidder to enter into a contract within ten days or reasonable time thereafter of the award that would warrant an extension beyond the ten day limit.
   (f)   Tabulation and Recommendation Procedure for Bids and Requests for Proposals.
      (1)   Tabulation. A tabulation of all bids and requests for proposals received shall be posted on the website for the City and available at City Hall for public inspection.
      (2)   Recommendations.
         A.   After opening and tabulating all bids and requests for proposals received, the purchasing agent shall determine the lowest responsible bidder pursuant to the criteria set forth in Section 246.08(b) and submit recommendations to Council.
         B.   If the purchasing agent or designee does not think the award should be given to the lowest bidder or submitter of proposal, a full and complete statement of the reasons for recommending an alternative award placement or recommending a higher bidder shall be prepared by the purchasing agent or designee, filed with the other papers relating to the transactions, and submitted with the recommendations to Council.
