§ 114.08 DRIVERS AND ATTENDANTS; QUALIFICATIONS; PROHIBITED ACTS.
   (A)   Qualifications. No person shall be employed or act as an ambulance driver or attendant unless such person shall meet the qualifications adopted by the State Department of Human Resources or representatives thereof.
   (B)   Prohibited acts. Any person employed or acting as a driver or attendant is hereby forbidden to commit or cause to be committed any of the following acts:
      (1)   To drive while under the influence of alcohol or other drug, or to drink any alcoholic beverage or take any drug, while on call;
      (2)   To smoke while inside the patient compartments, while the ambulance is moving or standing; or to smoke anywhere inside an ambulance which does not have separate patient and driver compartments while the ambulance is moving or standing;
      (3)   To move any patient if there is a suspicion of foul play without first notifying a law enforcement officer, unless necessary to preserve life or limb;
      (4)   To recommend to anyone a particular funeral home to handle a deceased person;
      (5)   To use profanity in the presence of patient, the patient’s family, or any bystander;
      (6)   To commit or cause to be committed an assault or battery on any bystander, unless necessary in defense of a patient or in self-defense; or
      (7)   To drive, or cause to be driven, any ambulance at speed greater than necessary without due regard for the safety of others.
   (C)   Emergency; EMT required. Every ambulance on an emergency mission in the county shall be occupied by at least one emergency medical technician, EMT/I, EMT/AT, or EMT/P.
   (D)   Non-emergency; EMTs required. Every ambulance transporting patients under conditions other than emergency run conditions shall be occupied by at least two emergency medical technicians.
