§ 93.02 CUTTING REQUIREMENTS; PERMIT; FEE.
   (A)   (1)   No person or entity shall cut into the surface of any street, curb or sidewalk without a street cut permit issued by the Town Superintendent.
      (2)   However, public utilities may make emergency cuts without the need to first obtain a permit. The utility company making an emergency cut shall notify the Superintendent immediately, or as soon thereafter as possible, of the occurrence of an emergency cut. Written notice shall follow after the original notice by the utility as soon as it is practicable.
   (B)   All persons cutting the surface of any street or sidewalk shall maintain all necessary guards, barricades and danger signals and shall furnish all necessary watchpersons to protect the public and the work during its progress. Upon the completion of the work, the person or entity performing the work shall refill all cuts to the original street specifications.
   (C)   The town shall charge an amount as set by the Town Council from time to time per permit application.
