§ 90.10  PROHIBITION OF CERTAIN ANIMALS WITHIN TOWN LIMITS.
   (A)   Notwithstanding any other provision herein contained, it shall be a violation of this chapter to keep, breed, maintain or house within the town limits any rabbit, horse, cow, swine, sheep, fowl other than chickens or other birds maintained in a cage, indoors, as household pets or any non-domesticated animal, except as otherwise herein permitted.
   (B)   The keeping of no more than 8 chickens per household is allowed, subject to the following restrictions:
      (1)   No roosters are allowed within the town limits.
      (2)   Chickens must be kept in a henhouse, coop, pen or fenced area at all times.
      (3)   During daylight hours, chickens may be allowed outside of their henhouse, coop or pen within a securely fenced yard only if supervised.
      (4)   During non-daylight hours, chicken must be secured within a henhouse, coop or pen.
      (5)   Henhouse, coops and pens must:
         (a)   Be kept neat, clean, dry, odor-free, and in a sanitary condition at all times;
         (b)   May not disturb the use or enjoyment of others due to noise, odor or other noxious conditions;
         (c)   Provide adequate ventilation, sun and shade; and
         (d)   Be impermeable to rodents, wild birds, and predators, including dogs and cats.
      (6)   All feed for chickens must be stored in a tightly closed metal container that is impermeable to rodents and other vermin.
   (C)   This section shall not be applicable to any person, firm or corporation maintaining and operating a veterinary hospital or clinic.
