§ 90.04 IMPOUNDING OF ANIMAL AND NOTICE.
   The animal control agency, upon having probable cause to believe that any person has allowed or caused an infraction of this chapter by doing or permitting 1 of the hereinbefore prohibited acts and upon observing any animal in performance of any act prohibited by this chapter, shall immediately take possession of the animal and impound the same in the animal pound. The animal control agency shall thereafter secure the identity of the owner or possessor of the animal as soon as it can be done and serve a notice on the owner or possessor of the animal, setting out the nature of the violation of the chapter, describing the animal, the time and place where the violation occurred and other data as may be necessary for the owner to have an understanding of the circumstances of the violation. The notice may be served upon the owner by personal delivery to his or her place of residence or by certified mail. The notice shall require the owner to appear at the animal pound of the town or another place as the town, by posted notice, shall hereafter require, within 48 hours after the service of the notice and pay the fees or penalties, hereinafter prescribed, for the violation. In the event that the person fails to appear within the designated time and pay the prescribed fees or penalties, the animal control agency shall proceed to enforce this chapter as otherwise hereinafter provided.
