3-3-3: LOCAL LIQUOR CONTROL COMMISSIONER:
   (A)   Mayor As Commissioner: The Mayor of the City shall be the Liquor Control Commissioner ("Commissioner") of the City. The Mayor may appoint a person or persons to assist him in the exercise of powers or performance of his duties.
   (B)   Powers, Functions And Duties: The Commissioner shall have the following powers, functions and duties:
      1.   To receive applications and subject to approval by ordinance of the City Council, to issue licenses to retailers in accordance with the provisions of this chapter and to suspend for not more than thirty (30) days or revoke for cause such licenses upon the Commissioner's determination, upon notice after hearing, that the licensee has violated any provision of this chapter or any rule or regulation issued pursuant thereto.
      2.   To adopt such rules and regulations consistent with the provisions of this chapter and the State Liquor Control Act as may be necessary to carry on the functions and duties of the Commissioner.
      3.   To enter or authorize any law enforcement officer to enter at any time upon the licensed premises to determine if any of the provisions of this chapter, the State Liquor Control Act or rules and regulations duly adopted by the City liquor control commissioner or the state liquor control commission have been or are being violated, and at such time to examine said premises of said licensee in connection therewith.
      4.   Have the right to examine, or cause to be examined, under oath, any applicant for a license or for a renewal thereof, or any licensee upon whom notice of revocation or suspension has been served in the renewal thereof, or any licensee upon whom notice of revocation or suspension has been served in the manner hereinafter provided, and to examine or cause to be examined, the books and records of any such applicant or licensee; to hear testimony and take proof and to issue subpoenas which will be effective in any part of the state.
      5.   To investigate changes in this chapter and recommend changes to the city council.
   (C)   Compensation: The city council is authorized to fix and pay compensation to the commissioner and such deputies, assistants or employees as are deemed necessary. (Ord. 0-39-94, 9-19-1994)
