ADOPTING ORDINANCE
ORDINANCE NO. 0-09-00
AN ORDINANCE READOPTING THE DARIEN CITY CODE IN ITS ENTIRETY UNDER THE CITY OF DARIEN'S HOME RULE AUTHORITY
   WHEREAS, a special census of the City of Darien was conducted by the United States Department of Commerce, Bureau of the Census; and
   WHEREAS, pursuant to notice filed with the City Clerk of the City of Darien, the results of the special census showed that as of May 4, 1998, the population of the City of Darien is in excess of 25,000; and
   WHEREAS, pursuant to Article VII, Section 6(a) of the Illinois State Constitution of 1970, any municipality which has a population of more than 25,000 is a home rule unit of government; and
   WHEREAS, the corporate authorities of the City of Darien have previously approved Resolution R-10-00, "A Resolution Acknowledging the Results of a Special Census Establishing Home Rule Status for the City of Darien"; and
   WHEREAS, as a home rule unit of local government, the City may exercise any power and perform any function pertaining to its government except as limited by Article VII, Section 6; and
   WHEREAS, the corporate authorities of the City of Darien have determined that it is in the best interests of the public health, safety and welfare of the City of Darien to readopt the Darien City Code in its entirety under the City's authority as a home rule unit of government.
   NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DARIEN, DU PAGE COUNTY, ILLINOIS, IN THE EXERCISE OF ITS HOME RULE POWERS, as follows:
   SECTION 1: That the Darien City Code, and as amended from time to time, is hereby readopted in its entirety under and pursuant to the City of Darien's home rule powers as established by Article VII, Section 6(a) of the Illinois Constitution of 1970.
   SECTION 2: This ordinance and each of its terms shall be the effective legislative act of a home rule municipality without regard to whether such ordinance should (a) contain terms contrary to the provisions of current or subsequent non-preemptive state law, or (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the City of Darien that to the extent that the terms of this ordinance should be inconsistent with any non-preemptive state law, that this ordinance shall supersede state law in that regard within its jurisdiction.
   SECTION 3: This Ordinance shall be in full force and effect from and after its passage and approval, and shall subsequently be published in pamphlet form as provided by law.
   PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF DARIEN, DU PAGE COUNTY, ILLINOIS, this 5th day of June, 2000.
