3-1-22: PENALTY; ENFORCEMENT:
   (A)   Unless otherwise expressly provided, any person convicted of violating any provisions of this chapter shall be fined not less than fifty dollars ($50.00) and not more than five hundred dollars ($500.00), except that the third and all subsequent convictions within any twelve (12) month period shall be deemed to be misdemeanors, and the person guilty thereof may be fined not less than ten dollars ($10.00) and not more than five hundred dollars ($500.00) and imprisoned for a period not exceeding six (6) months.
   (B)   Whenever a person shall neglect or refuse to procure any license required by this code, or otherwise violates the terms of this chapter, the mayor is authorized to cause appropriate legal action and proceedings to be instituted to enforce the license requirement.
   (C)   The clerk shall take all necessary and appropriate action to compel compliance with the regulatory provisions of this chapter. When necessary and expedient, he may call upon the chief of police to assist in such enforcement, and it shall be the duty of the chief of police to perform such enforcement acts as may be required of him. All municipal employees duly authorized and acting as license inspectors shall be conservators of the peace with police powers for the purpose of enforcing the provisions of this code and other municipal ordinances relating to the licensing of business and occupations and their regulations (1978 Code; amd.
