3-1-21: CERTIFICATE OF COMPLIANCE REQUIREMENTS:
   (A)   Definition:
   CERTIFICATE OF COMPLIANCE: Certificates issued by the city evidencing that a premises or place of business has been found to be in compliance with all applicable health and safety regulations of the city.
   (B)   Certificate Of Compliance Required: No premises or place of business (as business is defined in this code and even though the city may not license a particular business or businesses) shall operate within the city unless the owner or proprietor of said business obtains an annual certificate of compliance upon inspection by the city or its designated representative evidencing that such premises conforms to the provisions of this chapter and the other regulations of the city relating to health and safety of the premises. For the purpose of this requirement, each unit in a multi-unit building, wherein business activities are engaged, shall be considered a separate premises requiring a certificate of compliance.
   (C)   Issuance: Upon receipt of a properly executed application for certificate of compliance required by this section or other ordinances of the city and the required fee, the city clerk shall issue a receipt to the applicant and inform him that temporary permission is given to operate the proposed business subject to the inspections specified in this section. A statement to this effect shall be contained in the application.
The city clerk upon receipt of written notices of satisfactory inspection from the officials and departments specified in this section shall issue a certificate of compliance to the applicant.
   (D)   Applications And Contents: Each applicant for a certificate of compliance required by this section or other ordinances of the city shall properly execute the application form provided to him by the city clerk's office, which applications shall contain minimal information as determined by the city clerk.
   (E)   Administration: The administration of the provisions set forth in this section shall fall under the direct supervision of the city clerk's office and the city building department. The building official and/or such other officials of the city as designated by him shall conduct all inspections necessary to enforce this section.
   (F)   Certificate Of Compliance Fees: Each premises subject to the provisions of this section shall pay an annual certificate of compliance fee of fifty dollars ($50.00); however, those premises that are operating therein and pay an annual city business license fee shall not be required to pay any fee pursuant to the terms of this section.
