The properties listed on Exhibit A 1 shall have the opportunity to pay a connection fee of one hundred eighty dollars ($180.00) plus inspection and meter charges for the time period from January 1, 1991, to December 31, 1992, after which these properties shall pay the current connection fee; in addition, those properties on Exhibit A for which the owners have previously paid the charges set forth in subsection (A)2 of this Section shall have until December 31, 1995, within which to pay the one hundred eighty dollars ($180.00) connection fee plus inspection and meter charges.    (B)   Connection Fee: The connection fee is the permit charge only and does not cover the actual cost of connecting the service to the water main.
   (C)   Inspection Fee For Large Water Services: The inspection fee for water service lines four inches (4") in diameter or larger shall be charged a minimum of twenty five dollars ($25.00). Ten cents ($0.10) per lineal foot will be charged in addition to the initial twenty five dollars ($25.00) charge for each lineal foot of service line over two hundred fifty feet (250').
   (D)   Meter Fee: The meter fee is the permit charge for the meter only and does not cover the actual cost of the installation of the meter, lines or fittings.
   (E)   Meter Testing: Fifteen dollars ($15.00), if requested.
   (F)   Meter Repair: Damage to water meters caused by neglect or abuse on the part of the responsible person or persons in charge shall be charged to the account at the rate of twenty dollars ($20.00) plus the cost of repair parts or replacement meter if the damaged meter is beyond repair.

   (H)   Additional Connection Charges:
      1.   Water Connection Fee Surcharge: In addition to all other water connection or tap-on fees established by Municipal ordinances, there is herein a water connection and tap-on fee surcharge. Such surcharge, in addition to all other fees, must be paid by the applicant prior to the connection to the City water system. The surcharge shall apply to connections to all water lines installed at the cost of the City subsequent to the purchase by the City of an existing water utility system. The surcharge shall commence immediately after the passage and approval of this Ordinance and shall be immediately applicable to all existing lines installed by the City and to all lines installed by the City subsequent to the passage of this Ordinance. From the date that a Municipal water line is available and operational at the property line of a potential user, the amount of the water surcharge shall be fifty percent (50%) of the actual cost per foot of installation of water line times the number of front feet of the property seeking connection to the water system. The water surcharge set forth above shall apply to each residential unit. All other types of units shall pay a water surcharge in some multiple of the residential surcharge reflecting the ratio between the amount of water to be used by the nonresidential applicant. The amount of the fee shall be established by the City Engineer, and in the event that the user questions the fee, he may appeal to the City Council.
      2.   1981 Water Main Extension Program: Notwithstanding the provisions of any other ordinance, all potential water users who live in the area where water lines are installed as part of the City's "1981 Water Main Extension Program", which area is described in Project Plans by that name on file with the City Clerk and incorporated by reference herein, shall pay the following connection charges prior to connection to the City water system:
         (a)   A water connection charge representing the actual pro rata construction costs of the extension of such lines in said area on a per lot basis, as determined and certified by the City Engineer;
         (b)   The tap-on fees and water meter charges as set forth in this Chapter; and
         (c)   A surcharge of fifty dollars ($50.00) per month or each fraction thereof which ensues from July 20, 1981, to the date that application for connection is made as provided herein. The charge imposed by this subsection (H)2(c) shall not exceed one thousand two hundred dollars ($1,200.00).
         (d)   The charges set forth herein are subject to the following limitations and exceptions:
            (1)   Any potential user who on or before July 20, 1981, paid the connection charge established in subsection (H)2(a) of this Section shall not be required to pay the additional charge established in subsection (H)2(c) of this Section.
            (2)   For any potential user who makes application to establish a water connection to the City Water System within one year from the date that water lines are completed, operational and available at the user's property line, the tap-on fee as provided by this Chapter 4 shall be waived except as to that portion thereof representing the cost of water meters.
            (3)   No individual who has paid the charge described in subsection (H)2(a) of this Section on or before July 20, 1981, shall be required to connect to the City water system prior to July 20, 1991. Any individual who pays the charges described above subsequent to July 20, 1981, must connect to the City water system within ninety (90) days of the final acceptance of the water main extension improvements by the City Engineer, or ninety (90) days after receiving all permits as described herein, whichever is later.
         (e)   Any person who purchases a residential unit in the affected area, the closing date of such purchase being from June, 1981, through December 31, 1981, and who makes application for participation within six (6) months thereafter, shall be entitled to the rights and benefits of those potential users who made the payment described in subsection (H)2(a) of this Section on or before July 20, 1981.
         (f)   No person shall make any connection or install any water service in the area affected by this Section until a permit is obtained from the City upon the payment of all fees as required herein and elsewhere in this Title. Any permit issued hereunder shall require that all work be completed within ninety (90) days from the issuance of said permit or the permit will expire and be null and void, except that any permit obtained prior to final acceptance of the water main extension improvements by the City Engineer shall expire ninety (90) days after such acceptance.
         (g)   All individuals who pay the charge described in subsection (H)2(a) of this Section on the basis of an estimated pro rata share shall be entitled to a rebate by the City in an amount that said payment exceeds the actual pro rata share, based on final construction costs.
         (h)   The City shall determine the methods and manner of processing this rebate as soon as is reasonably possible following the completion of the "1981 Water Main Extension Program". The City Council shall endeavor to complete this determination within two (2) months after receipt and review of the first Water Department annual audit following the completion of said program.
         (i)   For good cause shown, and upon the concurrence of three- fourths (3/4) of the Aldermen, the requirements of this Section may be modified or waived in cases of special circumstances or undue hardships.
      3.   Water Connection Charges In Business Districts: In addition to any other charges provided in other ordinances, all water users located on property located within any of the business, OR and I, I or O Zoning Districts within the City shall pay a water connection charge representing the actual pro rata construction cost to the City of the extension of water lines to the area in which such property is located on a per lot basis as determined and certified by the City Engineer. In the event that there is a preexisting or nonconforming residential use on any such property, such residential water user shall pay only the tap-on fees and water meter charges as set forth in this Chapter and the connection charge imposed herein shall not be assessed until such time as the property is devoted to a use permitted in the zoning district in which it is located.       4.   Additional Connection Charges; Acquisition Areas: Notwithstanding the provisions of any other ordinance, all potential water users who live within the area described below, and who have City water available at the property line, shall pay the following connection charge prior to connection to the City water system:
         (a)   For all properties located in the area bordered generally by 75th Street on the north, Lemont Road on the west, Darien City limits on the south, and Fairview Avenue on the east, the owners thereof shall pay a connection charge of twenty nine dollars ($29.00) per front foot.
         (b)   For all properties located in the area bordered generally by Lemont Road on the west, Kearney Road (if extended south to I-55) on the east, Interstate 55 on the south, and the Darien city limits on the north, the owners thereof shall pay a connection charge of thirty three dollars ($33.00) per front foot.
         (c)   For all properties located in the area within the city extending west of Lemont Road to the Darien city limits between 83rd Street on the north and the Darien city limits on the south, and known generally as the Farmingdale Village area, the owners thereof shall pay a connection charge of thirty five dollars ($35.00) per front foot.
         (d)   For all properties being served by the former Lake-In-The- Woods System, the owners thereof shall pay a connection charge of thirty three dollars ($33.00) per front foot. This connection charge shall not apply to properties subject to recapture payments to the county of DuPage with respect to the county's extension of a certain water main along Plainfield Road.    (I)   Turn On Fee: Water service to any account which has been disconnected (shut off) for nonpayment of a water bill, repair bill or any other bill due the water division shall not be turned on except upon payment of the delinquent bill, and any other outstanding charges and a twenty five dollar ($25.00) turn on fee.
   (J)   Construction Water: With respect to construction water, fire hydrant meters will be provided upon the receipt of the appropriate cash deposit and charges for the meter use will be equal to the current water use rate for that district plus twenty percent (20%) for additional handling.
