5B-1-5: PRELIMINARY PLAT PROCEDURES AND REQUIREMENTS:
Before subdividing any tract or parcel of land in the City and the unincorporated area of planning jurisdiction as established by State statute an owner shall submit a preliminary plat and a final plat to be acted upon by the City authorities in accordance with the following requirements. Prior to the preparation of the preliminary plat drawings, and only after obtaining written authority from the Plan Commission, the owner shall consult with the City Engineer, and other City officials if required, to determine conformance with the Official Plan and Zoning Ordinance and compliance with this and other applicable City ordinances. Requirements for collector and minor streets, school sites, recreation sites, community facilities, shopping centers, sanitation, water supply and drainage facilities and their relationships to other developments, existing or proposed, in the vicinity shall be determined in advance of the preparation of preliminary plans.
   (A)   Subdivisions Of Not More Than Two Lots:
      1.   When an application for approval of a subdivision plat containing not more than two (2) lots and located within the City limits is submitted, the City Clerk shall refer such plat to the City Council and upon consideration thereof and after receiving a report from the Plan Commission, finding the intent and purpose of these subdivision regulations not violated, the City Council may approve such plat without further procedure.
      2.   The plat of such a subdivision submitted by the owner for approval shall meet all requirements for a final plat as required by these subdivision regulations.
   (B)   Preliminary Plat Procedures:
      1.   The owner shall file an application for approval of the preliminary plat with the City Clerk. Seven (7) copies of the preliminary plat and the required filing fee shall accompany the application.
      2.   The City Clerk shall refer five (5) copies of the preliminary plat to the Plan Commission, one copy to the City Engineer and one copy to the Public Works Supervisor.
      3.   The Plan Commission shall notify the owner as to the time and place of the Plan Commission meeting at which he will be afforded an opportunity of being heard. The City Engineer shall furnish the Plan Commission a report on his review of the preliminary plat.
      4.   The Plan Commission shall approve or disapprove the application for preliminary plat approval within ninety (90) days from the date of filing the application or the filing by the applicant of the last item of required supporting data, whichever date is later, unless such time is extended by agreement.
      5.   When the preliminary plat has been acted upon by the Plan Commission it shall be referred to the City Council. If the Plan Commission approves the plat it shall so indicate on the plat, and if it disapproves such plat it shall furnish the City Council a written statement setting forth the reasons for disapproval. The City Council shall accept or reject such plat within thirty (30) days after its regular slated meeting following the action of the Plan Commission.       6.   Upon approval of a preliminary plat by the City Council, the owner shall have one year to apply for final plat approval. In the event such application is not made, the preliminary approval shall be null and void and of no force and effect. The following notice of approval shall be stamped upon the prints thereof and required signatures affixed. (Ord. 0-21-71, 11-15-1971, as amended 1-25-1975; amd. Ord. 0-35-79, 8-20-1979)
   NOTICE OF APPROVAL OF PRELIMINARY PLAT
Notice is hereby given that the preliminary plat of the subdivision shown hereon has received approval by the City Council of the City of Darien, Illinois, and upon compliance by the owner with the necessary requirements or qualifications, the City Council will receive the final plat for consideration, if submitted by the owner in such form and within such time as required by Subdivision Regulations of the City of Darien. Unless this preliminary approval and the conditions are accepted within ten (10) days, this approval is null and void.
Application for final plat approval shall be made within one hundred eighty (180) days, and in the event such application is not so made, the preliminary plat approval hereby given shall be null and void and of no force and effect.

      7.   Distribution Of Approved Prints: The six (6) approved prints of such preliminary plat shall be distributed by the City Clerk as follows:
         (a)   Two (2) prints to the Plan Commission;
         (b)   One print to the City Engineer;
         (c)   One print shall be retained by the City Clerk for filing;
         (d)   One print shall be returned to the owner; and
         (e)   One print to the Public Works Supervisor.
      8.   Conditional Approval: Approval of the preliminary plat by the Plan Commission and City Council shall be conditioned upon stipulations as set forth in this Section.
   (C)   Preliminary Plat Requirements:
      1.   Identification And Description:
         (a)   Proposed name of subdivision not duplicating the name of any plat heretofore recorded in DuPage County, Illinois.
         (b)   Location by section, township and range, and by other legal description necessary to clearly locate and describe the subdivision area.
         (c)   A current survey prepared and certified by an Illinois registered land surveyor showing the topography, the boundary lines and the area being subdivided and all improvements drawn to a scale not smaller than one inch (1") to one hundred feet (100').
         (d)   Names and addresses of the owner having control of the tract and the surveyor who prepared the plat.
         (e)   North point (true point).
         (f)   Date of survey and preparation.
      2.   Existing Conditions:
         (a)   Boundary lines of proposed subdivision in accordance with subsection (C)1(c) of this Section.
         (b)   Total acreage of subdivision.
         (c)   Existing zoning districts in proposed subdivision and adjacent tracts.
         (d)   Location, widths and names of all existing or previously platted streets or other rights of way showing type of improvement (if any), railroad and utility rights of way, parks and other public open spaces, permanent buildings and structures, easements and section and corporate lines within the tract and to a distance of at least two hundred feet (200') beyond the tract.
         (e)   Location and size of existing sewers, water mains, culverts or other underground facilities within the tract and to a distance of at least two hundred feet (200') beyond the tract, also indicating such data as grades, invert elevations and locations of catch basins, manholes and hydrants.
         (f)   Location map, if required by the Plan Commission, drawn at a scale of not less than one inch equals one thousand feet (1" = 1,000'), showing boundary lines of adjoining, unsubdivided or subdivided land within an area bounded by nearest arterial streets or other natural boundaries, but not less than one-half (1/2) mile beyond the subdivision boundaries in subdivisions located beyond the City limits, identifying type of use and ownership of surrounding land and showing alignments of existing streets.
         (g)   Topographic data including the location of watercourses, marshes and other significant features and existing contours at vertical intervals of not more than two feet (2'), except in unusual topographical conditions; such vertical intervals may be required to be altered as determined by the City Engineer. Topographical data shall refer to the United States Geological Survey Datum. Soil boring data and seepage tests may be required at locations and depth as determined by the City Engineer.
         (h)   Locations of or reference to locations of existing monuments or survey markers used in preparation of survey and grade elevation of each monument and marker.
         (i)   Letter of approval from DuPage County Soil and Water Conservation District.
      3.   Proposed Subdivision Design Features:
         (a)   The proposed subdivision layout shall be in substantial accord with the Official Plan as amended from time to time.
         (b)   Layout of streets showing right-of-way widths and street names (not duplicating the name of any street heretofore used in the City or its environs unless the street is an extension of or in line with an already named street and provided it can be connected with such street in which event that name shall be used) and showing proposed through streets extended to boundaries of subdivision.
         (c)   Location and width of alleys, pedestrianways and easements.
         (d)   Layout, numbers, area in square feet and dimensions of blocks and lots to the nearest foot.
         (e)   Building line and all dimensions from lot lines.
         (f)   The proposed City zoning districts for subdivisions to be annexed.
         (g)   Areas (other than those listed in subsections (C)2(b), (C)2(c) and (C)2(d) of this Section), if any, intended to be dedicated or reserved for nonresidential purposes, indicating in each the approximate acreage and proposed use. Such areas shall be designated by letter or number.
         (h)   Proposed location of sanitary sewers, storm sewers, drainage courses and channels, methods of handling storm water, surface water disposal, sewage disposal and waste disposal plans.
         (i)   No land will be approved for occupancy in a subdivision which is subject to periodic flooding, which lies in flood plain areas as designated on the most recent applicable flood maps of the National Topographic Map Series published by the Geological Survey of the U.S. Department of Interior, or which contains inadequate drainage facilities, unless the owner agrees to make all necessary improvements and agrees to all required covenants which will, in the opinion of the City Engineer, City Attorney and Plan Commission, be binding, make such land safe for occupancy and provide necessary safeguards for adjacent property which will be affected by the grading, drainage or other changes being permitted or required for this subdivision.
   (D)   Land Improvement Plans And Specifications: After the approval of the preliminary plat and prior to filing an application for approval of a final plat, the owner shall submit to the City Clerk preliminary plans and specifications prepared by a registered engineer for required land improvements and detained grading plans of lots and blocks. The City Engineer and other public officials having jurisdiction shall approve or disapprove such preliminary plans and specifications or may set forth the revision necessary for approval.
