4-3-20: REVOCATION OF PERMIT, VIOLATION OF REGULATIONS AND PENALTIES:
   (A)   Revocation Of Permit: The Director is hereby authorized and empowered to revoke any sign permit issued by him if there has been a violation of the provisions of this sign code.
      1.   In the event that the person to whom the sign permit has been granted fails to complete or assure completion of the work required in accordance with the provisions of the permit, the Director shall notify such person in writing of any such failure. If such failure is not corrected within ten (10) days after notification, the sign permit may be revoked by the Director.
      2.   Any sign permit issued under this sign code may be revoked by order of the City Council or the Director when it is shown by satisfactory proof:
         (a)   The permit was issued without or in excess of the authority of the Director;
         (b)   The application for the sign permit contained material misrepresentation of the fact; or
         (c)   The sign(s) was/were erected, constructed, reconstructed, altered or used in a manner not in compliance with the submittals which served as the basis for the issuance of the permit.
      3.   In the event of revocation of a sign permit, the sign(s) authorized by said permit shall be removed promptly at the expense of the applicant.
      4.   If, after a sign permit is granted, the sign covered by such permit shall not be constructed, erected and/or installed within six (6) months after the date thereof, then the sign permit shall expire by the terms thereof, and no sign thereunder shall be constructed, erected and/or installed until a new sign permit has been granted.
   (B)   Violation Of Regulations:
      1.   If the Director shall find that any sign is unsafe, insecure or a menace to the public, or has been constructed, erected or maintained in violation of the provisions of this sign code, the Director shall give written notice of such condition or violation to the person to whom the permit for said sign has been issued, or if no permit has been issued, the owner, agent or person having the beneficial use of the building, structure or property upon which said sign is located. If the party to whom notice was given fails to remove or alter the sign or sign structure so as to comply with the regulations set forth in this sign code within ten (10) days after such notice, the Director shall remove the sign at the expense of the owner of the sign.
      2.   Any sign which no longer identifies a bona fide business conducted or a product sold on the premises where said sign is located is in violation of this sign code and shall be taken down and removed by the owner, agent or person having the beneficial use of the building, structure or property upon which the sign is located within ten (10) days after written notification by the Director. Upon failure to comply with such notice, the Director shall remove the sign at the expense of the owner of the sign.
      3.   In addition to other remedies as specified in this sign code, the City may institute any appropriate action or proceeding to prevent, restrain, correct, or abate any violation of this sign code, including such actions as may be necessary for the City to recoup costs incurred in pursuance of the removal or alteration of signs as may be required by this sign code. The cost of removal shall be deemed to include any incidental expenses, as well as all direct and indirect costs incurred by the City in connection with the removal of the sign.
      4.   In the event a sign presents an immediate peril or hazard to persons or property, the Director may cause the sign to be removed summarily and without notice. Such removal without notice shall not preclude the City from recouping costs of such removal.
      5.   The Director shall not issue any sign permit to any person who refuses to pay costs or expenses incurred by the City in removing or altering any sign for which the person has previously obtained a permit, regardless of whether legal proceedings have been initiated for the purpose of recovering such costs.
   (C)   Penalties: Any person violating any of the provisions of this sign code shall be fined not less than twenty dollars ($20.00) nor more than five hundred dollars ($500.00). Each day such violation is committed, or permitted to continue, shall constitute a separate offense with respect to the computation of fines. (Ord. 0-38-94, 9-6-1994; amd. Ord. 0-04-00, 4-3-2000)
