§ 53.10  AUTHORITY.
   (A)   The town establishes a Stormwater Utility under the authority of I.C. 36-9-23.
   (B)   The Stormwater Utility shall be responsible for the management of the Danville stormwater system.
   (C)   The Stormwater Utility’s stormwater management activities shall be funded by user fees to be paid by persons and entities owning and using real property in the town that receive and transmit stormwaters.
   (D)   The determining feature used to identify real properties transmitting stormwaters shall be the existence of impervious surface area.
