§ 94.21 DRIVEWAY PERMIT APPLICATION AND REVIEW.
   (A)   No new driveway construction shall be started nor shall any existing driveway be subject to modification until an application for a driveway addition or modification permit has been submitted to the town and the town has issued a permit for the driveway to be constructed or modified. The requirement for a driveway addition or modification permit under this section shall not be applicable to any planned new driveway construction that has been subject to other town regulation and review regarding the location of and specifications for the driveway.
   (B)   In reviewing an application to construct or modify a driveway, the Town Planner and Public Works Superintendent shall apply AASHTO standards of traffic safety engineering. In making a determination whether to approve a driveway as proposed in an application, they may consider other relevant factors including, but not limited to, the quantity or quality of traffic, the existence of on-street parking, sight distance, adjacent land use, development of access away from arterial streets and onto side streets, anticipated development in the area and speed limits. If after such review the town approves the construction or modification of the driveway, the Town Planner shall issue a driveway addition or modification permit.
   (C)   Any driveway so reviewed and approved shall meet the applicable specifications of the following sections of this chapter.
