§ 94.09 COMPLIANCE; BOND.
   (A)   Each public and/or private utility doing business within the corporate limits of the town shall file with the Clerk-Treasurer of the town a corporate surety bond in the principal sum of $10,000, as and for assurance to the Town Council, that each of the utilities shall fully comply with the provisions hereof regulating the maintenance, repair, cutting, construction, reconstruction or alteration of public streets, alleys, curbs, sidewalks and other public ways within the town.
   (B)   In the event that any utility shall fail to comply with the provisions of division (A) above, permits are as provided for in §§ 94.01 through 94.08 shall not be issued until compliance is accomplished.
   (C)   Any person, business, corporation or other entity, other than public or private utilities, which shall make application for a permit to cut, construct, reconstruct or lay an pavement on any public street, alley, curb, sidewalk or other public way, or to repair the same, or alter the same, shall be obligated to make application and to pay the stated permit fee, as set out in § 94.02(C) and the inspection fee of $50, as stated in § 94.02(C). The person, business, corporation or other entity shall also be obligated to file with the Clerk-Treasurer of the town a corporate surety bond in the principal sum of $10,000, cash bond as assurance to the Town Council that each of the persons, businesses, corporations or other entities shall fully comply with the provisions hereof, as to construction, maintenance, repair, alterations, cutting of, construction or reconstruction of public streets and alleys within the town.
