§ 33.27 APPOINTMENT TO FIRE OR POLICE DIVISION; PROMOTIONS.
   (A)   Appointment. In the event that an entry-level vacancy occurs in the Fire or Police Divisions which the City desires to fill, the Mayor shall so notify the Board, which shall appoint a person who is on the eligibility list or Lateral Transfer Eligibility List to fill the vacancy in the division in question. The Board shall notify the Mayor and the appointee in writing of any level-entry appointment, and the appointee shall have a period of seven days to accept the appointment by written notice to the Board or its designee.

   (B)   Promotions.
      (1)   All cases of vacancies within the ranks of the Fire or Police Divisions which are above the entry-level rank and which are subject to appointment by the Board under § 33.22, shall be filled by promotion from the next lowest rank in the division. No promotion shall be made by the Board unless the Mayor shall first notify the Board in writing that a vacancy exists which is to be filled.
