§ 33.22 APPOINTMENT OF MEMBERS OF FIRE AND POLICE DIVISIONS.
   (A)   The Board shall appoint all members and ranks of the Fire and Police Divisions of the City, except the Director of Public Safety and the Deputy Director(s) of Police, if any, who shall be appointed by the Mayor with the consent of the City Council as herein provided.
   (B)   If a member of the Police Division or of the Fire Division is appointed Director of Public Safety, or if a member of the Police Division is appointed Deputy Director of Police prior to being eligible to retire on pension, he shall be considered as on furlough from the rank he held immediately prior to such appointment. If the appointee resigns from the appointed position or is removed or discharged prior to attaining eligibility to retire on pension, he or she shall revert to and be established in such prior rank, and thereafter be entitled to all the benefits and emoluments of such prior rank, without regard as to whether a vacancy then exists in such rank.
   (C)   All appointments by the Board to the Fire or Police Divisions, other than that of the lowest rank, shall be from the rank next below that to which the appointment is made, and a certificate of appointment signed by the chairman and secretary of the Board shall be issued to each person so appointed by the Board.
   (D)   Each full-time member of the Fire or Police Divisions appointed hereunder is an officer of the City.
