§ 152.034 AMENDMENTS.
   (A)   The Town Board of Aldermen may from time to time amend the terms of this chapter. Any proposed amendment shall either be proposed by or be referred to the Planning Board for its review and recommendation.
   (B)   Unless first proposed by the Planning Board, no application shall be considered by the Planning Board unless it has been properly completed and submitted to the Subdivision Administrator at least 14 days prior to the Planning Board meeting at which it is to be reviewed.
      (1)   This requirement may be waived by a unanimous vote of the Planning Board membership present at the meeting.
      (2)   The Planning Board shall have 45 days from the date at which it met to review the application to submit its recommendation to the Town Board of Aldermen.
      (3)   If a recommendation is not made during the 45-day period, the application shall be forwarded to the Town Board of Aldermen without a recommendation from the Planning Board.
   (C)   No amendment shall be adopted by the Town Board of Aldermen unless a public hearing has been held on the amendment.
      (1)   Notice of the public hearing shall be published in a newspaper of general circulation in the town at least once a week for two successive calendar weeks prior to the hearing.
      (2)   The initial notice shall appear not more than 25 nor less than ten days prior to the hearing date.
      (3)   In computing the ten- to 25-day period, the date of publication is not to be counted, but the date of the hearing is.
