(A) In order to ensure orderly development of the community in accordance with any adopted plan or ordinance, the Town Board of Aldermen (in approving a preliminary plat of a major subdivision containing five acres of land or greater) may require that the subdivider reserve open spaces for a park, fire station, police station or library for a period of up to one year after the final plat has been recorded.
(B) The reservation shall not constitute more than 10% of the total land area included within the subdivision. If the town or the county does not develop this land by the end of the one-year period, the subdivider may treat the land as being freed of the reservation.
