(a) Whoever is convicted of violating Section 856.05 shall be guilty of a minor misdemeanor for a first offense, and subject to a maximum fine of one hundred dollars ($100.00). Conviction for a second or subsequent offense for a violation of Section 856.05 shall be a misdemeanor of the fourth degree for which the penalty shall be a fine of up to two hundred fifty dollars ($250.00), or imprisonment for not more than 30 days, or both.
(b) Whoever is convicted of violating Section 856.03 shall be guilty of a first degree misdemeanor, subject to a penalty of not more than one thousand dollars ($1,000) or imprisonment for not more than six months, or both.
