1464.06 LOCATION OF FENCES; SURVEY.
   No property owner shall install or construct, or cause the installation or construction of, a fence on any property except his or her own property, unless such encroachment into other property is pursuant to the written consent of the other property owner. Prior to any fence being placed within three feet or less from the lot property lines, the owner of the lot shall have the lot surveyed by a registered surveyor, who shall submit a drawing to the Building Commissioner indicating the location of the proposed fence in relation to the property lines, and such location shall be subject to the approval of the Building Commissioner. The Building Commissioner may waive the aforementioned survey requirement, provided that the fence being installed or constructed is replacing a fence which existed in the exact location immediately prior to the new installation or construction and the owner presents the Building Commissioner with written consent for such waiver from the adjacent property owner who shares the property line. A fence may not be constructed within three feet or less of the property line unless both of the conditions below are satisfied:
   (a)   The fence is constructed with maintenance-free materials, as determined and pre-approved by the Building Commissioner; and
   (b)   The fence is constructed so it can be easily dismantled and maintained from the interior side of the fence.
