This chapter shall not apply to the removal or excavation of any soil or other substance which is only incidental to work or construction authorized under a building permit lawfully issued by the Building Commissioner pursuant to the requirements of other ordinances of the Village, nor shall it apply to operations in existence prior to July 20, 1955, which heretofore have been authorized by written agreement with the Village, as long as the terms of the agreement are fully and completely complied with in all respects.
