452.032 PROHIBITED PARKING OF COMMERCIAL VEHICLES, COMMERCIAL TRAILERS, COMMERCIAL EQUIPMENT, AND NON-COMMERCIAL TRAILERS IN RESIDENTIAL DISTRICTS.
   (a)   No person shall stand or park a commercial vehicle, commercial equipment, or commercial trailer on any Village street adjacent to a residential district, except where necessary to avoid conflict with other traffic or to comply with the provisions of this Traffic Code or while obeying the directions of a police officer or other traffic control device on any Village street.
   (b)   The parking or storage of commercial vehicles, commercial equipment, or commercial trailers in any residential district, other than in a garage or enclosed structure, is prohibited, except that a commercial vehicle or commercial trailer may be parked outside of a garage or enclosed structure for a reasonable period of time when making a customary delivery of goods or services to the premises. For purposes of this section, “commercial vehicle” means any vehicle that is used for business, commercial or manufacturing purposes that bears one or more of the following: has three or more axils, mounted equipment, racks for carrying equipment, ladders and ladder racks, building materials, or similar items, and/or displays commercial signage or advertising of a commercial venture on the vehicle itself. For the purposes of this section, “commercial trailer” means any trailer that is used for business, commercial, or manufacturing purposes,
   (c)   The parking or storage of any construction vehicle or equipment in any residential district is prohibited, except that temporary parking or storage of construction vehicles or equipment shall be permitted where such construction vehicle or equipment is being used for the building, renovation, maintenance or improving of a dwelling, accessory structure, road, driveway or sidewalk at, or near, the premises upon which it is located, until the project has been completed. For purposes of this section “construction vehicle or equipment” means any vehicle, earth-moving equipment, backhoe, bulldozer, cement mixer, hoist, scaffold, temporary storage units, and any other device or tool used in the construction or maintenance of buildings, houses, roads, streets, sidewalks, driveways, or for landscaping.
   (d)   Except as provided in division (f) of this section, non-commercial trailers shall not be parked on any street or right of way in a residential district.
   (e)   Except as provided in division (f) of this section, non-commercial trailers shall not be parked in on any street or right-of-way in a residential district when the trailer or semitrailer is not attached to a vehicle of motor power used in connection with the movement thereof.
   (f)   Non-commercial trailers may be parked on any street or right-of-way in a residential district for a reasonable period of time when said trailer is actively being utilized at the premise adjacent to where it is temporarily parked.
   (g)   Whoever violates any provision of this section is guilty of a minor misdemeanor for the first offense. For the second or subsequent offense, such person shall be guilty of a misdemeanor of the third degree.
