248.06 TREE TRIMMING AND TREE REMOVAL SERVICE FOR RESIDENTS OF THE VILLAGE.
   (a)   The Service Director is hereby authorized and directed to receive proposals on a bi-yearly basis for a program for tree trimming and tree removal service to the residents of the Village on an as-needed basis.
   (b)   The Mayor, with the approval of Council, is authorized to accept proposals for tree trimming and tree removal on a bi-yearly basis.
   (c)   The Clerk is to place a notice in the Cuyahoga Heights Village News Letter notifying the residents of the program and a form for the residents to request this service, if needed.
   (d)   The limit of the number of tree trimming and removals per year per residential lot shall be as follows: one removal and two trims per calendar year for each property owner.
   (e)   Upon receiving emergency service requests based on an act of nature, the Service Director shall prioritize and schedule based on the severity of the threat to property, environment or safety. These emergency service requests will not count towards the limit set in division (d) of this section.
   (f)   The Service Director, or his or her designee, shall compile a tree trimming and tree removal list and schedule the tree trimming and tree removal services so that the appointed professional tree service can provide a full day of services when working. The Service Director's list shall prioritize the work to be performed based on the severity of the threat to public property, the environment or safety and any past services rendered under this program.
   (g)   A property owner, before any trimming, must submit an application, waiver of liability and right of entry before removal may occur on private property. All forms shall be subject to the review and approval of the Law Director.
