9.12.021 Exclusions.
   This chapter does not apply to the following:
   A.   Certain Elemental Metals. The following elemental metals included within the purview of Section 9.12.020 shall not be considered hazardous materials for purposes of this chapter unless they are stored in a friable, powdered or finely divided state: beryllium, cadmium, chromium, copper, lead, nickel and silver;
   B.   Retail Products. Hazardous materials contained solely in consumer products packaged for distribution to, and use by, the general public or commercial products used at the facility solely for janitorial or minor maintenance purposes such as paint thinner or wax strippers;
   C.   Work Station. Hazardous materials located at a work station in a quantity reasonably required for use as determined by Cupertino under the circumstances;
   D.   Exemption. Cupertino shall exempt any material from the requirements of this chapter where it has been demonstrated to the satisfaction of Cupertino that the material in the quantity and/or solution stored does not present a significant actual or potential hazard to the public health, safety or welfare.
