GENERAL PROVISIONS
§ 94.01 PURPOSE.
   The purpose and intent of this chapter is to:
   (A)   Provide a systematic application process for events having an effect on public property and/or public services;
   (B)   Lessen undue impact on private property;
   (C)   Ensure that city, state, and federal codes are adhered to; and
   (D)   Recapture any city expenditures lost for the development of, and operational costs for, a privately sponsored event.

§ 94.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   EVENT. Any parade, race, or special event that requires closure of a public street, special traffic control, or services of the city beyond the normal and ordinary services of the city.
   PARADE. Any parade, march, or procession in or upon any street except the sidewalks thereof, or in or upon any alley in the city.
   RACE. Any organized bicycle race, foot race, race walking, wheelchair racing, rollerblading, marathon, jogging event, and similar events.
   SPECIAL EVENT. Any privately sponsored event, as defined by above, which occurs on a public street, sidewalk, or any municipal property. This includes, but is not limited to, any fair, show, carnival, sporting event, school event, and grand opening.

§ 94.03 PERMIT REQUIRED, PROCEDURE EXCEPTIONS.
   (A)   No person shall engage in, participate in, aid, form, or start any event, unless a permit has been procured therefor.
   (B)   No permit shall be required for:
      (1)   Wedding or funerals, including wedding or funeral processions;
      (2)   Governmental agency acting within the scope of its functions;
      (3)   Lawful picketing or other public discourse that constitutes the free exercise of constitutionally protected activities and does not disrupt or interfere with traffic on public streets or the use of public places by other members of the public; or
      (4)   Any event involving 99 or fewer people, that is less than three hours in duration, that does not involve the closing of city streets or diversion of traffic, does not require any special city services, and does not involve sales or consumption of alcohol.

§ 94.04 DUTIES OF PERMIT HOLDER.
   (A)   A permit holder hereunder shall comply with all permit directions and conditions and with all applicable laws and ordinances. The permit holder shall carry the event permit upon his or her person during the conduct of the event.
   (B)   (1)   Within the two-hour period immediately following the end of the event, the permit holder will clean up, remove, and dispose of all litter or material of any kind, which is placed or left on the street, park, or other public property because of such event. Should the permit holder fail to do so, the city may bill the permit holder for all costs related to the clean-up.
      (2)   In addition, no future applications will be considered until all obligations are satisfied.

§ 94.05 INDEMNIFICATION AGREEMENT.
   If the event or any portion of the event is to be held on city property or right-of-way, prior to the issuance of a special event permit, the permit applicant and authorizing officer of the sponsoring organization, if any, must sign an agreement to indemnify, defend, and hold the city, its officials, employees, and agents harmless from any claim that arises in whole or in part out of the special event, except any claims arising solely out of the negligent acts or omissions of the city, its officials, employees, and agents.
