Notwithstanding the provisions of § 51.002 of the Code of Ordinances of the City of Crittenden, it shall be permissible to harbor fowl within the confines of the City of Crittenden pursuant to the following. Non-crowing fowl, such as hens, may be kept within the city limits for non-commercial purposes, subject to the following provisions.
(A) The non-crowing fowl shall be kept in a housing structure that is:
(1) Covered and predator-proof;
(2) Thoroughly ventilated and odor-free;
(3) Designed to prevent any bird from leaving the owner's property;
(4) Of sufficient size to admit free movement of each bird, providing at least three-square feet of space per bird; and
(5) Designed to be easily accessed, cleaned, and maintained by the owners.
(B) The housing structure must be in good repair. All gates or doors to the fence or structure shall fit properly and shall be locked or secured by a latch.
(C) No non-crowing fowl shall be located closer than four feet to the owner's residence, and no non-crowing fowl shall be located closer than ten feet to any residential structure occupied by someone other than the fowl owner, custodian, or keeper.
(D) Stored feed must be kept in a rodent and predator-proof container.
(E) No more than eight non-crowing fowl shall be kept on a lot smaller than one-half acre.
(F) All non-crowing fowl will be housed and kept in the rear of the residence.
