§ 50.004 ABATEMENT PROCEDURE
   Whenever a nuisance as set forth in § 50.003 is found to exist within the city or within the city's extraterritorial jurisdiction, the health officer or some other duly designated officer of the city shall give written notice to the owner or occupant of the property upon which the nuisance exists upon the person, owner, occupant, invitee, guest, licensee, manager, agent, corporation, or other individual or entity causing, permitting, or maintaining the nuisance by hand-delivery or certified mail to the last known address of th property owner as it appears on the current tax assessment roll and stating that the nuisance must be remedied within fifteen (15) days of receipt of the written notice. Upon failure to remedy or correct the nuisance in a satisfactory manner within the seven (7) day period, or upon return back to the city of the certified letter addressed to the last known address of the property owner as it appears on the current tax assessment roll, whichever occurs first, the authorized city official is authorized to send city employees or other duly authorized officers or agents upon the property to remove, remedy, and abate the nuisance situation accordingly at the cost of the individual or entity causing, permitting, or maintaining the nuisance to be invoiced and paid within ten (10) days then made a part of the individual or entity’s tax bill if unpaid; is authorized to file a lien as stated in § 50.005; and assess other penalties as stated in § 50.999. Failure of the City to abate the nuisance does not waive the City's claim of the nuisance or ability to abate at a future time, nor does it waive the City's ability to assess the other penalties as stated in Section 50.999, as the City's ability to abate the nuisance may be cost, time, ability, or otherwise prohibited.
