9-12-6: PERMIT:
No person shall operate a qualified off-highway vehicle on any street or highway under the jurisdiction of the village unless a permit has been issued by the Chief of Police with respect to such vehicle in the manner provided by this section; provided, however, that a golf cart may be operated without a permit as part of a special event upon approval of the Village Board. Any person seeking a permit to operate a qualified off-highway vehicle within the village shall submit a signed application to the Chief of Police on a form provided by the village together with a Forty dollar ($40.00) permit application fee. Such form shall, at a minimum, require the following information:
   (A)   The name and address of the owner and any operator of the qualified off-highway vehicle;
   (B)   A copy of a valid driver's license of the owner and any operator of the qualified off-highway vehicle;
   (C)   The serial number, make, model and description of the qualified off-highway vehicle;
   (D)   A certificate of insurance verifying that the qualified off-highway vehicle and any operator is covered by insurance as provided in this chapter; and
   (E)   A signed waiver of liability to be provided by the village to the applicant.
Upon receipt of an application for a permit to operate a qualified off-highway vehicle within the village, the Chief of Police or his designee shall inspect the qualified off-highway vehicle to determine that the qualified off-highway vehicle is equipped as required by this chapter and that all such required equipment is in operational condition. Upon verification that a qualified off-highway vehicle contains operational safety equipment as required by this chapter, the Chief of Police shall issue a permit sticker authorizing the operation of the qualified off-highway vehicle on streets or highways under the jurisdiction of the village. The driver of any qualified off-highway vehicle being operated on a street or highway within the jurisdiction of the village shall affix and maintain the permit sticker issued in accordance with this chapter on the front windshield of the qualified off-highway vehicle at all times when it is so operated.
A permit issued under the authority of this section shall expire on December 31 each year, when a change in ownership of the qualified off-highway vehicle occurs, or upon revocation by the Chief of Police for non-compliance with this chapter. Permits issued under this chapter shall not be transferrable in the event of a change of ownership. Permits may be renewed annually in the same manner as the original permit, including payment of the Forty dollar ($40.00) permit application fee. (Ord. 893, 10-23-2019)
