§ 125.10 QUALIFICATIONS FOR PERSONNEL.
   (A)   No person shall act as a nurse’s aide, orderly, or nurse technician in a home regulated by this chapter, nor shall any person, under any other title, not otherwise licensed by the state or the village, assist with the care of patients in a home regulated by this chapter, unless the person meets the following requirements:
      (1)   Be at least 16 years of age, temperate habits, good moral character, honest, reliable and trustworthy;
      (2)   Be able to speak and understand the English language;
      (3)   Provide evidence of his or her employment for two years prior to his or her present employment;
      (4)   Have completed at least eight years of grade school or provide proof of equivalent knowledge;
      (5)   Successfully complete a course of training for nurse’s aides, orderlies, and nurse technicians approved by the Illinois Department of Public Health;
      (6)   Have completed a drug test showing the absence of illegal drugs;
      (7)   Had no felony convictions in the past ten years as indicated by a background check and fingerprinting conducted by a state licensed and certified private investigative firm; and
      (8)   Be familiar with and have general skills related to patient care in such areas as bathing, grooming and feeding of patients; making beds; giving enemas; and taking patients’ temperatures.
   (B)   Persons subject to the provisions of this section shall perform their duties under the direct supervision of a registered nurse or a licensed practical nurse.
   (C)   It shall be unlawful for any person to act as a nurse’s aide, orderly, or nurse, or under any other title, not licensed by the state, to assist in the care of patients in a home regulated by this chapter, unless such person has complied with the provisions of this section.
   (D)   It shall be unlawful for any home regulated by this chapter to employ any person in the capacity of nurse’s aide, orderly, or nurse technician or under any other title, not licensed by the state to assist in the care of patients in such home regulated by this chapter, unless such person has complied with the provisions of this section.
   (E)   Proof of compliance by each such employee with the requirements set out above shall be maintained for each such employee by each home regulated by this chapter in the individual personnel folder of each such employee.
