For the purpose of this chapter, the following definition shall apply unless the context clearly indicates or requires a different meaning.
PRIVATE SWIMMING POOLS. Any permanent or portable type receptacle for water or an artificial pool of water having a depth at a point of more than two feet or with a surface area exceeding 250 square feet, constructed, installed and maintained in or above the ground, outside of a building used for an individual owner, his or her family and friends; provided that, a private residential swimming pool is maintained by an individual primarily for the sole use of his or her household and guests and not for the purpose of profit or in connection with any business operated for profit.
