§ 136.03 VANDALISM.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      LEGAL GUARDIAN. Includes a person appointed guardian of the person or given custody of a minor by a circuit court of the state or any other state, but does not include a person appointed guardian only of the estate of a minor or appointed guardian or given custody of a minor under the State Juvenile Court Act.
      MINOR. Includes a person who is above the age of 11 years, but not yet 18 years of age.
      PARENT. Includes the lawful father or mother of a minor child, whether by birth or adoption.
      PERSON. Includes any individual, firm, partnership, association, corporation, company or organization of any kind.
      PROPERTY. Includes any real estate, including improvements thereon, and tangible personalty.
      SUFFERANCE OF VANDALISM. The failure to interfere, prohibit and prevent the act or commission of an act of vandalism by a minor.
      VANDALISM. Includes any of the following acts:
         (a)   Maliciously, recklessly or knowingly damage, deface or destroy any property of another person without his or her consent;
         (b)   Maliciously, recklessly or knowingly, by means of fire or explosive device, damage, deface or destroy any property of another person;
         (c)   Maliciously, recklessly or knowingly start a fire on the land of another person without his or her consent;
         (d)   Maliciously, recklessly or knowingly deposit on the land or in a building of another person, without his or her consent, any stink bomb or any offensive smelling compound and thereby interfere with the use and occupancy by another of the land or building; or
         (e)   Maliciously, recklessly or knowingly and without authority enter into any building, house trailer, motor vehicle, aircraft or watercraft or any part thereof of another person without his or her consent.
   (B)   Special hours for Halloween day. "Trick or treat" time in the village shall occur from 3:00 p.m. until 7:00 p.m.
   (C)   Vandalism prohibited. It shall be unlawful for any person to commit any act of vandalism upon either public or private property within the village. Each separate act of vandalism shall be considered as a separate violation of this section.
   (D)   Parental responsibility.
      (1)   It shall be unlawful for any parent or legal guardian of an unemancipated minor who resides with the parent or legal guardian to suffer or permit the minor to commit an act of vandalism upon either public or private property within the village.
      (2)   Each separate act of vandalism shall be considered as a separate violation of this section.
