(A) Definition. For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
PYROTECHNICS. Any sparkler, squib, rocket, firecracker, Roman candle, signal lights, railroad track torpedo, flashlight composition, fireworks or other devices or composition used to obtain visible or audible pyrotechnic display and shall include fire balloons, that is, balloons of a type which have burning material of any kind attached thereto.
(B) Storage and use. No person shall have, keep, store, use, manufacture, sell, handle or transport any pyrotechnics; provided, however:
(1) Nothing in this section shall be held to apply to the possession or use of signaling devices for current daily use by railroads, vessels and others requiring them;
(2) The Board of Trustees and Mayor may, upon due application, issue a permit to a properly qualified person for giving a pyrotechnic display of fireworks in the public parks or other open places. The permits shall impose restrictions as, in the opinion of the Fire Chief and Board of Trustees and Mayor, may be necessary to properly safeguard life and property in each case; and
(3) Nothing in this section shall be held to apply to the possession, sale or use of normal stocks, as determined by the Fire Chief, of flashlight compositions by photographers or dealers in photographic supplies.
