(A) Firefighting services authorized; area designated. The members of the village Fire Department shall perform usual and customary firefighting and rescue services in the village.
(B) Outside of village firefighting services authorized; area designated. The members of the village Fire Department are authorized to provide and perform firefighting service to and for owners or occupants of residential premises outside the corporate limits of the village within the area as previously designated in Ords. 953 and 2132 on file in the office of the Village Clerk and incorporated herein by reference, on the terms and conditions set forth in this section.
(C) Firefighting service requirements and restrictions.
(1) Requirements and restrictions on receiving service. Firefighting services shall be provided to and performed only for:
(a) Residential property owners who have:
1. Executed an agreement of a form as provided in Exhibit B attached to Ord. 953 on file in the office of the Village Clerk and incorporated herein by reference; and
2. Provided the documentation required pursuant to the agreement.
(b) Residential property owners who shall pay an apparatus and response charge of $75 for the first hour (or less) and $50 for each additional hour (or portion thereof).
(2) Village Fire Department restrictions.
(a) The Fire Department and members thereof shall not leave the village in providing service pursuant to this section at any time when the Fire Department is:
1. Responding to an alarm or rescue call within the village;
2. Fighting a fire in the village; or
3. Responding pursuant to a mutual aid agreement with other municipalities.
(b) No service shall be provided to premises outside of the village unless, at the time, one complete unit of firefighting apparatus and sufficient members of the Fire Department to operate the apparatus remain in the village.
(D) Ambulance services.
(1) The Fire Department paramedics may provide ambulance and rescue service in case of emergency requiring the pre-hospital care and transportation of persons who are sick, injured, wounded or otherwise incapacitated or helpless at the time of dispatch of a Fire Department emergency services vehicle.
(2) The response shall normally be limited to the territory within the corporate limits of the village.
(3) Service outside the corporate limits of the village shall be limited to the following circumstances:
(a) Circumstances governed by contract or a mutual aid agreement with another community.
(b) Extreme life-saving emergency and necessity.
(4) Fees for basic life support ambulance service shall be provided as follows:

(6) The responsive fee for treat/non-transport shall be $300.
(7) The village will accept Medicare-approved rates for all residents. Non-residents shall be billed for all sums not reimbursed by Medicare. All sums not reimbursed by all other insurance plans shall be payable by residents and non-residents alike.
(8) Fees for all other supplies shall be billed as established by the Fire Chief from time to time and published.
(9) A RESIDENT means any individual who resides in the village or an employee of any business holding a valid business license in the village.
(10) Ancillary Fire Department charges shall be as follows:

(11) In addition, a charge of $200 will be billed to any individual involved in a vehicle accident which services were provided by the Crestwood Fire Department. A minimum fee of $250 will be assessed to reimburse the village for vehicle fires. A charge of $200 will be assessed to reimburse the village for the cost for any wash down of oil, gasoline, etc. Additional charges shall also be assessed to reimburse the village for the reasonable cost of other medical supplies and material used in providing services rendered. In no event shall charges for materials and medical supplies exceed the reasonable cost incurred by the village to purchase and replace these items.
(12) Emergency services may be rendered or provided by the village, through its Fire Department personnel or other duly authorized personnel, to persons who reside outside the village boundaries. The persons residing in unincorporated areas adjacent to the village may enter into a separate agreement for out-of-village services with an additional documentation fee of $75, and undertaking to pay all other fees and charges. If a non-resident agreement is not in effect for persons residing or a residence outside of the village, the minimum charge for each response will become $150 for the first piece of apparatus, $50 for each Chief Officer, and $100 for each additional piece of apparatus per hour, plus other applicable fees and charges.
(13) Upon good cause shown, the village may waive charges to village residents to the extent not covered by health insurance, government insurance or the plans of medical reimbursement or direct payments.
(E) Inspections. All premises covered in accordance with the terms of this section shall be open to inspection by the Fire Chief and/or a fire prevention officer of the village, or by anyone else designated by the Village Board, at any time, and any agreement for extending firefighting service pursuant to this section, and the payment of the rate herein prescribed may be cancelled by the village at any time by refunding the proportionate part of the rate paid for the unexpired term.
(F) Service runs with the land. The privileges created by accepting the provisions hereof and paying the charge prescribed shall run with the land, and the benefits thereof shall accrue to any person acquiring title to any premises covered thereby, provided the person shall sign an agreement accepting the provisions of this section in accordance with Exhibit B attached to Ord. 953 on file in the office of the Village Clerk.
(G) Non-liability of village.
(1) Neither the village, its officials, employees or any member of the Fire Department shall be under any liability for any failure to respond to a call for service to any of the premises covered by the terms of this section or for any act performed or for the failure to act when responding to a call or on the premises in response thereto.
(2) Furthermore, the subject property owner or owners shall indemnify and hold harmless the village and all of the village’s officers, agents and employees from any damages, judgments, expenses or costs of any type whatsoever, including legal fees and costs incurred by the village, or any of its officers, agents or employees, arising by virtue of the providing of, or failure to provide, volunteer firefighting service to the property owner. Furthermore, the property owner shall consent that, in the event any court action is commenced against the village and/or any of its officers, agents or employees, this indemnity agreement may be pleaded by the village and/or any of its officers, agents or employees in the court action, and the property owner shall consent to be joined in any such court action by virtue of a third party complaint to be filed by the village and/or any of its officers, agents or employees to enforce the indemnity provisions of this section and the property owners’ agreement.
