§ 154.106 HARDSHIP.
   (A)   If an applicant believes that any provision of this chapter is unreasonable or unnecessary as applied to his or her proposal, he or she may request a waiver from such provision. Such request shall be made during the Planning Commission review of the plan.
   (B)   The Planning Commission shall make a recommendation to the Borough Council regarding such request as part of their review.
   (C)   The authority to grant or deny such a waiver request shall rest with Borough Council.
   (D)   If granted, the date of such granting and the section number of the provision waived shall be added to the plan and shall appear on the copy of the plan endorsed by the borough. If granted at preliminary plan stage, this notice shall also appear on the final plan.
   (E)   If denied, failure to comply with the provision for which the waiver was requested shall be sufficient cause for denial of plan approval.
