(A) Upon receiving an application, the City Police Chief will investigate the applicant. The City Police Chief may deny the application if:
(1) The applicant has violated any provisions of this chapter within the prior two years of the current application date;
(2) The applicant has falsified any of the information on the application;
(3) The applicant was convicted of a felony or other action constituting an offense against the person under I.C. 35-42, an offense against property under I.C. 35-43, or an offense against public health, order, and decency under I.C. 35-45; or
(4) The applicant is deemed unsuitable for solicitation within the city based on the Police Chiefs investigation.
(B) The Police Chief will provide the reason for denial of an applicant in writing. An applicant who is denied a solicitor's license may appeal that decision within 20 days of receiving notice that the application has been denied. Such appeal must be made in writing to the Board of Public Works and Safety stating that the applicant was denied a solicitor's license and wishes to appeal. The Board of Public Works and Safety will hear the appeal at a public hearing within 20 days of receiving the applicant's request.
