§ 30.04 EXECUTIVE DEPARTMENTS.
   (A)   There is hereby established a Department of Law pursuant to IC 36-4-9-4 with the powers and duties as set forth in IC 36-4-9-12. The Department of Law shall also be governed by applicable ordinances of the city as set out in this code of ordinances which are not in conflict herewith.
   (B)   There is hereby established a Department of Parks and Recreation to be controlled and operated by the Park and Recreation Board established pursuant to IC 36-10-3-3. Such Department shall also be subject to applicable ordinances set out in this code of ordinances as applied to the Parks and Recreation Department, which are not in conflict herewith and not in conflict with IC 36-10.
   (C)   (1)   There is hereby established a Department of Planning and Economic Development. The Department shall consist of two divisions:
         (a)   Planning Division, organized under IC 36-7-4-204.
         (b)   Economic Development Commission, organized under IC 36-7-12-4.
      (2)   Both of the divisions in the Department of Planning and Economic Development shall also be subject to applicable ordinances of the city as contained in the city code, which are not in conflict herewith and not in conflict With the appropriate provisions of Indiana law.
   (D)   The members of the Board of Public Works and Safety are the Mayor, the City Attorney or the Assistant City Attorney and the City Engineer, or one other person appointed by the Mayor. The Chief of the Fire Department and the heads of the Department of Sewage and Street and Sanitation Department are appointed by the Mayor to serve at his pleasure (IC 36-4-9). Pursuant to IC 36-4-9-2, the Mayor shall also appoint the heads of the Parks and Recreation Department, the Planning and Economic Development Department and the Manager of the Airport, subject to and with the approval of the statutory Board or Commission operating such Department. The Mayor shall also appoint the Manager of the Electric Utility of the city subject to and with the approval of the Utility Service Board. Subject to the appropriation power of the Common Council, the foregoing departments shall have the ability to hire such employees and purchase or contract for such materials or services as the Board of Public Works and Safety or other governing Board or Commission deems necessary to perform their public functions.
