§ 30.03 LEGISLATIVE BRANCH.
   (A)   The legislative branch of the city is the Common Council. The Council shall have exclusive authority to adopt ordinances and appropriate tax moneys received by the city, and to perform any other necessary and desirable legislative functions.

   (B)   The Clerk-Treasurer shall be the Clerk of the Common Council and shall perform the duties prescribed by IC 36-4-6-9 and such others as the Council may direct, by ordinance or other official act. The Clerk-Treasurer shall perform other duties prescribed by IC 36-4-10-4 and IC 36-4-10-4.5.
   (C)   The Mayor, or in his or her absence, the President of the Council, who shall be elected by the Common Council at the first meeting of the Council’s new term, shall be the presiding officer of the Council pursuant to IC 36-4-6-8, and meetings shall be conducted pursuant to the applicable statutes (IC 36-4-6-10 through 36-4-6-17) and in accordance with all other pertinent ordinances of the city heretofore passed by the Common Council which are not in conflict herewith, which are hereby adopted and reaffirmed as part of this section.
