§ 30.02 EXECUTIVE BRANCH.
   (A)   The Mayor is the city executive and head of the executive branch. He or she shall faithfully perform the duties and responsibilities contained in IC 36-4-5 and other statutes of the state, and also in accordance with the ordinances of the city as may be applicable. The position of Deputy Mayor is hereby established for the city. Whenever the Mayor is going to be absent from the city, ill or injured, he may designate a person to fill this position so established as Deputy Mayor, and after such appointment and certification, as hereafter provided, the Deputy Mayor shall have full power of the office of the Mayor. A designation under this section shall be certified to the City Council and Clerk-Treasurer of the temporary absence of the Mayor. The Mayor shall certify to the Common Council and the Clerk-Treasurer, the expiration of the designation as Deputy Mayor, or the Mayor may make the appointment for a certain period of time. The designee shall reside within the city.

   (B)   There is hereby established a Board of Public Works and Safety within the executive branch. Such Board shall be the chief administrative body of the city and shall have control of the day to day operations of the following:
      (1)   Fire Department.
      (2)   Sewerage Utility.
      (3)   Street and Sanitation Department.
      (4)   City Planning Commission.
      (5)   Economic Development Commission.
      (6)   City Engineer.
   (C)   The Police Department, the Park and Recreation Department, the Utility Service Board and the Board of Aviation Commissioners shall also be a part of the executive branch of the city, subject to the appropriate Board and Commissions of such Department’s control of the day to day operations of each of said departments, and as provided by law and the ordinances of the city.
