(A) At the time of applying for a building permit, any person desiring to make use of the sanitary sewer system in connection with such construction and to tap into the system shall pay a tap-on and inspection fee as follows:

(B) Whenever any owner or other person whose land is to be served by the sanitary sewer system of the city desires to pay such tap-on fee in installments, he may do so providing he pays at time of applying for a building permit the first installment of the tap-on fee plus the inspection fee and at the same time enters into an agreement in writing in consideration of that privilege, that he will make no objection to any illegality or irregularity with regard to the tap-on fee or the authority of the city as to the matter of amount, requirement, form, procedure or collection of such tap-on fee. In such event the tap-on fee may be paid by the owner of such real estate in equal monthly installments over a period of ten years and shall be billed to the user along with the rates or charges for sewerage service with interest at 6% per annum upon the balance from time to time unpaid. Such unpaid tap-on fee shall be a lien upon the lot, parcel or real estate and buildings and shall be collectable as sewerage charges are collectable, all as provided in IC 36-9-23-1 et seq. and any acts amendatory or supplemental thereto.
