(A) Pursuant to IC 36-8-12.2-8.1, there is hereby created a Hazardous Materials Response Fund, a nonreverting fund within the Fire Department of the city which shall consist of any and all monies that the Department may receive from emergency action reimbursement charges, all of which shall be and hereby is done pursuant to IC 36-8-12.2-8.
(B) The purposes of this Fund are as set forth in IC 36-8-12.2-8.
(C) The Board of Public Works and Safety, as the body that oversees the Fire Department budget, shall be the body which approves expenses from this Fund and which approves claims from this Fund to be submitted to the Clerk-Treasurer.
