§ 35.70 PARK AND RECREATION NON-REVERTING OPERATING FUND.

   (A)   Established. The Park and Recreation Department Non-Reverting Program Operating Fund 215 ("Program Fund") is created.

   (B)   Funding. This Program Fund will be funded by reasonable fees collected for certain Park and Recreation Department programs and facilities.

   (C)   Use. This Program Fund will be used exclusively for the purpose of operating the various programs of the Park and Recreation Department.

   (D)   Annual reconciliation and excess funds. Notwithstanding division (C) above the Board of Parks and Recreation must annually reconcile the revenues and expenditures of the Fund and determine at the end of each fiscal year whether the Fund has an excess balance above the estimated required balance needed to effectively operate the Fund without deficit in the next fiscal year; and, if there is an excess, the Board is required to transfer the lesser of:

      (1)   The total excess balance; or

      (2)   10% of the Fund to Fund 206 Park and Recreation General.

      (3)   For the end of fiscal year 2019, the Board is required to transfer $10,000 from the Fund to Fund 206 Park and Recreation General.

   (E)   Non-reverting fund. This is a non-reverting fund.
