(A) There is re-established the Cumulative Capital Development Fund ("the CCD Fund") within the city.
(B) The purposes of the CCD Fund are every approved purpose I.C. 36-9-15.5 provides, as it may be amended from time to time and the city will follow I.C. 36-9-15.5 regarding CCD Fund expenditures. CCD Fund monies, therefore, may be used for statutory purposes, including:
(1) I.C. 8-16-3 allows for certain bridge capital expenditures;
(2) I.C. 8-22-3-25 allows for certain airport capital expenditures;
(3) I.C. 14-33-14 concerns conservancy district channel improvements, levees, and water retarding or impoundment structures;
(4) I.C. 16-23-1-40 concerns city-owned hospitals;
(5) I.C. 36-8-14 allows for certain fire and police capital expenditures;
(6) I.C. 36-9-4-48 concerns public mass transportation;
(7) I.C. 36-9-16-2 allows for the following expenditures:
(a) To purchase, construct, equip, and maintain buildings for public purposes;
(b) To acquire the land, and any improvements on it, which are necessary to construct public buildings;
(c) To demolish any improvements on land acquired under this section, and to level, grade and prepare the land for the construction of a public building;
(d) To acquire land or rights-of-way to be a public way or other means of ingress or egress to land acquired to construct a public building;
(e) To improve or construct any public way or other means of ingress or egress to land acquired to construct a public building;
(8) I.C. 36-9-16-3 allows for the following expenditures:
(a) To acquire land or rights-of-way to be used for public ways or sidewalks;
(b) To construct and maintain public ways or sidewalks;
(c) To acquire land or rights-of-way for the construction of sanitary or storm sewers, or both;
(d) To construct and maintain sanitary or storm sewers, or both;
(e) To acquire, by purchase or lease land, buildings, or rights-of-way for the purchase price of a utility;
(f) To purchase or lease land, buildings, or rights-of-way for any utility that is acquired or operated by the unit;
(g) To purchase or acquire land, with or without buildings, for park or recreation purposes;
(h) To purchase, lease, or pay all or part of the purchase price of motor vehicles for the Police or Fire Department, or both, including ambulances and firefighting vehicles with equipment, ladders, and hoses;
(i) To retire in whole or in part any general obligation bonds of the unit issued for acquiring or constructing improvements or properties that would qualify for cumulative capital improvement funds;
(j) To purchase or lease equipment and other consumable personal property needed by the unit for any public transportation use;
(k) In a county or a consolidated city, to purchase or lease equipment to be used to illuminate a public way or sidewalk;
(l) For the following purposes:
1. To purchase, lease, upgrade, maintain, or repair:
a. Computer hardware;
b. Computer software;
c. Wiring and computer networks;
d. Communication access systems used to connect with computer networks or electronic gateways;
2. To pay for the services of full-time or part-time maintenance employees; and
3. To conduct nonrecurring in-service technology training of unit employees;
(9) I.C. 36-9-16.5 allows acquiring rights-of-way for public ways or sidewalks or the construction or reconstruction of public ways or sidewalks;
(10) I.C. 36-9-17 allows for the construction, repair, or improvement of streets, alleys, sidewalks, curbs, gutters, and sewers;
(11) I.C. 36-9-26 allows for expenditures for storm and sanitary sewer systems;
(12) I.C. 36-9-27-100 allows for expenditures for building, remodeling, and repairing park and recreation facilities, or purchasing land for these purposes;
(13) I.C. 36-10-4-36 allows for additional park capital expenditures; or
(14) I.C. 36-9-15.5(8)(c) allows for certain emergency expenditures.
(C) The tax rate for the CCD Fund will be and may not exceed $.05 per $100 of assessed valuation and shall be levied beginning with taxes assessed in 2020 and due in the year 2021, continuing until reduced or rescinded.
