§ 111.01 PURPOSE AND DEFINITIONS.
   (A)   The purpose of this chapter is to regulate passenger vehicles carrying passengers for hire, as defined herein, in order to preserve the health and welfare of the citizens of the town and the protection of their property. For the purposes of this chapter, wherever within the context it appears appropriate, each term stated in either the singular or plural shall be in the singular or plural, and pronouns stated in the masculine, feminine or neuter gender shall be the masculine, feminine and the neuter.
   (B)   Unless otherwise specifically provided, or unless clearly required by the context, the words and phrases defined below shall have the meaning indicated when used in this chapter:
      ADMINISTRATOR. See TAXICAB ADMINISTRATOR.
      BENEFICIAL INTEREST IN A BUSINESS OPERATING MOTOR VEHICLES CARRYING PASSENGERS FOR HIRE. A person having such a beneficial interest means:
         (a)   An individual owner, if the business is a sole proprietorship;
         (b)   Any partner (including a limited partner) if the business is a partnership;
         (c)   Any officer or stockholder, if the business is incorporated; or
         (d)   Any person owning a motor vehicle used by the business operating motor vehicles for hire. The owner shall be the person or entity listed on the title issued by the state’s Department of Motor Vehicles; provided, however, that, an owner of a vehicle leased to the certificate holder pursuant to a valid written lease shall not be considered a BENEFICIAL OWNER.
      CERTIFICATE. See CERTIFICATE OF CONVENIENCE AND NECESSITY.
      CERTIFICATE OF CONVENIENCE AND NECESSITY. The license issued by the Chief of Police or his or her designee, authorizing a person to operate a motor vehicle carrying passengers for hire company or taxicab company.
      CHIEF OF POLICE. The Chief of Police for the Town of Cramerton or his or her designee.
      CODE ADMINISTRATOR. The person appointed by the Town Manager to serve as the Administrator of the code of ordinances for the town.
      MANIFEST. A daily record prepared by the driver or dispatcher of all trips made by the motor vehicle carrying passengers for hire or taxicab, showing time and place of origin, destination of each trip, amount of fare and the driver’s name and cab number.
      MOTOR VEHICLE CARRYING PASSENGERS FOR HIRE. Any motor vehicle, other than a bus operated by a transit system of any municipal government, that is used to transport passengers for a fee payable by such passengers, but is exempted from regulation by the state’s Utilities Commission under the provisions of G.S. § 62-260.
      OPERATOR. Any person who physically operates a motor vehicle carrying passengers for hire or taxicab.
      OPERATOR’S PERMIT. The license issued by the Taxicab Administrator to any person to enable that person to operate a motor vehicle carrying passengers for hire of taxicab.
      RATE NOTICE/FARES. The card displayed within a motor vehicle carrying passengers for hire and taxicabs, describing the schedule of fares charged by the motor vehicle operator carrying passengers for hire or taxicab and posted in accordance with § 111.20.
      STREET. Any road, alley, avenue, highway or any other public vehicular area within the corporate limits of the town as the same may exist or may be hereafter extended.
      TAXICAB. A motor vehicle carrying passengers for hire that seats nine or fewer passengers and that is operated upon any street or highway on call or demand, accepting or soliciting passengers indiscriminately for hire between such points along streets or highways as may be directed by the passenger or passengers so being transported.
      TAXICAB ADMINISTRATOR. The Chief of Police or his or her designee.
      TOWN. The Town of Cramerton, North Carolina, or its authorized agent(s).
