§ 130.08 PUBLIC INTOXICATION.
   If any person shall be drunk or shall be in a state of intoxication in any highway, street or alley within the limits of the town, every such person shall be deemed guilty of a misdemeanor and, on conviction thereof, shall be fined in any sum not less than $5 nor more than $25, and the Town Marshal is hereby authorized and empowered to, and it is hereby made his or her duty to, arrest, or cause to be arrested, with or without process, any person or persons found violating any of the provisions of this section, and to commit any person or persons to some safe place in said town until sober, at which time, or as soon thereafter as may be, such person shall be taken before the Police Justice to be dealt with according to law.
