(A) Horse-drawn vehicle/carriage drivers shall travel only those boundaries, as herein designated, for horse-drawn vehicle/carriage travel, including special occasion travel routes as approved by the Police Chief or his or her designee.
(B) Any authorized area of travel for horse- drawn vehicle/carriage businesses is subject to the right of the city, through its Police Department, to prohibit the use thereof at any time when such area of travel would be inconsistent with other special events or public safety requirements.
(C) Horse-drawn vehicles/carriages are prohibited from traveling in the city between the hours of 1:30 a.m. and 9:00 a.m. at all times.
(D) Horse-drawn vehicles/carriages are prohibited from traveling in the city between the hours of 3:00 p.m. and 6:00 p.m., Monday through Friday, except on national legal holidays.
(E) No driver shall operate a vehicle/carriage while under the influence of intoxicating liquors or drugs.
(F) No person may consume edibles, including soft drinks, nor drink any alcoholic liquor or be intoxicated as defined by law while such person is operating or being transported by a horse-drawn vehicle/carriage, nor may any person transport, carry, possess or have any alcoholic liquor while being transported by a horse-drawn vehicle/carriage, except in the original package with the seal unbroken, in the city.
(G) The driver shall observe and obey all traffic laws and regulations of the city and the state.
(H) No driver shall abandon his or her vehicle/carriage, permit another to drive for him or her, except an apprentice, or permit any passenger to ride on the driver’s seat.
(I) Drivers shall never permit the seating capacity rated for his or her vehicle/carriage to be exceeded.
(J) The licensee shall not permit vehicles/ carriages to travel the city streets unless the following is adhered to.
(1) Each vehicle/carriage with a seating capacity not to exceed seven, including the driver and guide, may be operated by one or more horses.
(2) Each vehicle/carriage with a seating capacity from eight to 14, inclusive, including driver and guide, shall be operated with not less than two horses.
(3) Each vehicle/carriage with a seating capacity from 15 to 48, inclusive, including driver and guide, shall be operated with not less than four horses.
(K) No passenger shall be permitted to stand or ride on any part of the vehicle/carriage while in motion, except seated inside the vehicle/carriage. Drivers shall take all necessary precautions to prohibit such activity. All passengers must be seated, except when loading or unloading.
(L) Drivers or passengers shall not solicit, annoy or obstruct in any manner the movement of a person, or follow any person for such purpose.
(M) Drivers are prohibited from smoking while carrying passengers for optimum safety and control of the horse-drawn vehicle/carriage and the safety of its occupants.
(N) The driver of each horse-drawn vehicle/ carriage during travel from one-half hour after sunset and at all such other times as conditions exist for poor visibility, shall cause the front lights and tail lights of the vehicle/carriage to be in operation.
(O) The driver of each horse-drawn vehicle/ carriage upon approaching or exiting a bridge, and during travel on the bridge, shall have the yellow lights flashing in a continuous fashion.
(P) The driver of a horse-drawn vehicle/ carriage shall not travel on the same bridge in the same direction at any point in time while another such vehicle/carriage is traveling thereon. However, travel in caravans from two up to and including five vehicles/carriages may travel by escort with yellow lights flashing, but said bridge travel must not encompass more than six minutes from time of entrance to time of exit from the bridge.
(Q) The driver shall not permit the speed at which any horse-drawn vehicle/carriage is driven to exceed a slow trot.
