(A) Specific designated operational area and approved routes. No commercial quadricycle business or commercial quadricycle shall be operated outside of a specific designated operational area unless special permission is granted by the city. Any specific designated operational area of travel for a commercial quadricycle business or commercial quadricycle is subject to the right of the city, through its Police Department, to prohibit the use thereof at any time when such area of travel would be inconsistent with other special events or public safety requirements. A commercial quadricycle must be operated only on an approved travel route within the specific designated operational area. A person desiring to operate a commercial quadricycle business or commercial quadricycle shall submit, as part of his or her application, a proposed travel route or routes. The City Manager, or his or her designee, after conferring with other city departments and staff as applicable, may accept, deny or propose modification to the proposed route or routes. If a commercial quadricycle business desires to change, alter or otherwise modify one or more of its approved travel routes, it must submit such a request, in writing, to the City Manager. The City Manager, or his or her designee, after conferring with other city departments and staff as applicable, may accept, deny or propose modification to the requested route change, alteration or modification.
(B) Hours of operation. A commercial quadricycle business must comply with all applicable laws, ordinances and regulations regarding alcoholic beverages. In addition, no commercial quadricycle shall be operated between the hours of 9:00 p.m. and 11:00 a.m. on weekdays (Sunday through Thursday) and 12:00 a.m. and 11:00 a.m. on weekends (Friday and Saturday).
(C) Specific prohibitions and requirements. It shall be unlawful for a commercial quadricycle business and any employee, agent or independent contractor therefor to:
(1) Operate a vehicle that does not meet the definition of “commercial quadricycle”;
(2) Allow passengers to ride in a manner other than on a permanent and regular seat attached to the commercial quadricycle;
(3) Carry more passengers than the number of seats available on the commercial quadricycle;
(4) Operate the commercial quadricycle in a manner that results in damage to public property;
(5) Operate the commercial quadricycle in a manner that results in a collision or impact with a pedestrian;
(6) Operate the commercial quadricycle in a manner that obstructs pedestrian traffic on a sidewalk;
(7) Allow another to attach their person, bicycle, coaster, sled, toy vehicle, roller skates, skateboard, scooter or other rolling device to the commercial quadricycle;
(8) Allow any trailer or other rolling device to attach to the commercial quadricycle;
(9) Operate a commercial quadricycle on a street or alley that has been closed by the city to motor vehicles or vehicles;
(10) Solicit or accept substitute or additional passengers at any time after the commercial quadricyle begins a route;
(11) Operate a commercial quadricycle that has exposed rust, ripped upholstery or fabric, or exposed wood that is not in good condition;
(12) Allow a passenger to possess more than three alcoholic beverages of any kind on the commercial quadricycle;
(13) Allow passengers to bring opened packages of alcoholic beverages onto a commercial quadricyle;
(14) Allow passengers to drink alcoholic beverages from an container other than a non-descript plastic cup while occupying or riding the commercial quadricycle;
(15) Allow passengers to bring or possess any glass containers of alcoholic beverages on the quadricycle;
(16) Allow passengers to bring opened packages or drinks of alcoholic beverages from retail premises onto the commercial quadricycle;
(17) Allow the sale, offer for sale or offer of any samples of alcoholic beverages;
(18) Allow noise to emanate from the commercial quadricycle in a manner that would be a nuisance to others;
(19) Operate a commercial quadricycle at a speed which poses a danger to its passengers, other vehicles or pedestrians;
(20) Operate a commercial quadricycle while under the influence of intoxicating liquors or drugs;
(21) Consume edibles, including soft drinks, nor drink any alcoholic liquor or be intoxicated as defined by law while serving as the driver of a commercial quadricycle;
(22) Disregard or disobey any traffic law and regulation of the city and the state;
(23) Abandon his or her commercial quadricycle, permit another to drive for him or her, or permit any passenger to ride on the driver’s seat;
(24) Permit the seating capacity rated for a commercial quadricycle to be exceeded;
(25) Allow passengers to stand or ride on any part of the commercial quadricycle while in motion, except seated inside the commercial quadricycle. All passengers must be seated except when loading or unloading; or
(26) Solicit, annoy or obstruct in any manner the movement of a person, or follow any person for such purpose.
(D) Lighting requirements. The driver of each commercial quadricycle during travel from one-half hour before sunset and at all such other times as conditions exist for poor visibility, shall cause the front lights and tail lights of the commercial quadricycle to be in operation. The driver of each commercial quadricycle upon approaching or exiting a bridge and, during travel on the bridge, shall have the yellow lights flashing in a continuous fashion.
(E) Standards for loading And unloading passengers. No commercial quadricycle shall load or unload passengers in any manner which poses a safety risk to its passengers, other vehicles or pedestrians. No commercial quadricycle shall load or unload passengers in a way which damages property. When loading or unloading passengers, a commercial quadricycle shall not block or impede pedestrian or vehicular traffic or otherwise stop or park in any manner prohibited by any law, ordinance or regulation.
